AffirmQuest is a personal growth application that combines positive affirmations with RPG-style gameplay. Our Service includes:

• Personalized affirmation generation and delivery
• RPG-style character progression and battles
• Scheduled affirmations via email, push notifications, SMS, or voice calls
• Hero's Journey interactive story experiences
• Premium features including custom affirmations

3. User Accounts

3.1 Account Creation

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your account information
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access

3.2 Account Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you represent that you have your parent's or guardian's permission to use the Service.

7. AI-Generated Content

AffirmQuest uses artificial intelligence (OpenAI GPT-4) to generate personalized affirmations. You understand and agree that:

• AI-generated content may not always be accurate or appropriate
• You should use your judgment when following AI-generated advice
• AI-generated affirmations are not a substitute for professional medical or mental health advice
• We are not responsible for any decisions made based on AI-generated content

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability, fitness for a particular purpose, or non-infringement
• Warranties that the Service will be uninterrupted, secure, or error-free
• Warranties regarding the accuracy or reliability of any content

AffirmQuest is not a medical or mental health service. The Service is for personal growth and entertainment purposes only and is not intended to diagnose, treat, cure, or prevent any medical or mental health condition.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AFFIRMQUEST SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, data, or use
• Business interruption
• Personal injury or property damage
• Emotional distress

Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless AffirmQuest, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any rights of another party.

11. Termination

You may terminate your account at any time by deleting your account through the Service settings or contacting us at support@affirmquest.io.

11.2 Termination by Us

We may suspend or terminate your access to the Service immediately, without notice, if you violate these Terms or engage in any fraudulent, abusive, or illegal activity.

11.3 Effect of Termination

Upon termination, your right to use the Service will cease immediately. We may delete your account data in accordance with our Privacy Policy. Sections of these Terms that by their nature should survive termination will survive.

12. Third-Party Services

The Service integrates with third-party services, including but not limited to:

• Clerk (authentication)
• Stripe (payments)
• OpenAI (AI generation)
• Twilio (SMS and voice)
• Firebase (push notifications)

Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the practices of third-party services.

13. Dispute Resolution

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which AffirmQuest operates, without regard to conflict of law principles.

13.2 Dispute Resolution Process

If you have a dispute with us, you agree to first contact us at support@affirmquest.io to attempt to resolve the dispute informally. If we cannot resolve the dispute within 60 days, you agree to resolve disputes through binding arbitration or small claims court, as applicable.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of the Service after such changes constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using the Service.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and AffirmQuest regarding the Service and supersede all prior agreements and understandings.
